Justice?

Justice is supposed to be blind, I never knew it was supposed to be anonymous and ignorant too.

A 17-year-old girl who struck and killed a motorcyclist during a hit-and-run crash last year in Des Moines "made a series of poor decisions" but she should not be prosecuted as an adult, the Iowa Supreme Court ruled Friday.

The case involves Esther Chisala and her "series of poor decisions" that started, just days before her 18th birthday, when she bought the car without her (mother's) permission and then disobeyed her mother who had begged her daughter not to drive it.

Chisala ran away from home after being instructed not to drive the car and she drove without having a driver's license and without buying any insurance.

Chisala's next "series of poor decisions" occurred while she was "going too fast and hit (a van belonging to Iowa Homeless Youth Services) and was trying to get away."

Chisala's successive "series of poor decisions" proved fatal to James Miller, as Chisala ran a red light and hit the gentleman on the motorcycle.

From there Chisala's "series of poor decisions" included leaving the scene of the second accident she caused and proceeding to "...hit a light pole about a half block up the road. Hit a light pole, spun sideways and" get "out of her car and started to walk away."

It was only through the interjection of two citizens, honored this month at an annual Crime Fighter Banquet, that Chisala was detained and escorted back to the scene of one of her "series of poor decisions".

One month after all of this came another in a "series of poor decisions" courtesy of District Judge Carol Egly, who decided Chisala should not be tried as an adult.

On appeal of that ruling is how the Iowa Supreme Court became involved.

In their anonymous (unsigned) decision the Supreme Court stated...

"At the time of the accident, Chisala had no prior involvement with the court system".

"Although she had some previous problems at school, there had been no 'office referrals' for three years, and she was on schedule to graduate from high school."

Really?

Then why would the then vice principal at Scavo Campus (an alternative high school in Des Moines) say Chisala, "was enrolled at Scavo last school year (2007), but attended classes through Future Pathways, a program that helps students recover credits. She was classified as a senior last year, but didn't graduate, he said. Chisala had not yet registered for classes this school year. (2008).

The Supreme Court ruling cited testimony of a school counselor who described Chisala as a model student with no behavioral problems and good attendance.

Reads like somebody's lying to me!

My snarky side thinks Marsha Ternus had a huge hand in this and wants to remain anonymous because of the recent events involving her child.

For all intents and purpose Esther Chisela was an adult, she bought a car and enlisted in the Iowa National Guard the day before her accidents.

The Iowa Supreme Court knew this, Chisela should be tried as an adult and punished as one.

For the Iowa Supreme Court, this is another in a "series of poor decisions" and the scientific community is united in that fact.

James Miller could not be reached for comment.

Word Up

Hold onto your cod pieces kids, because at $2.24 million per word we're going to be taking it in the shorts from the House health care bill.

And the scientific community is united in that fact.

The grand total cost...$1.055 Trillion

Not to worry boys and girls, the Dummycrats assured us the bill would be a net deficit reduction as well as end the war on terrorism.

Keep in mind estimates are preliminary and "subject to substantial uncertainty", which means actual cost may vary and considering it involves the government, you can expect it to be considerably higher.

BOHICA!

I Won't Dance

For numerous reasons I found Harry Reid's bipartisan health care analogy deeply disturbing.

"You can't dance if your partner is unwilling to get off the chair."

"It's like when I was in high school, I wanted to dance but she wouldn't get up. OK?"

Dancing In The Dark is the only way he'd ever stand a chance and the scientific community is united in that fact.

Definitely NEVER Dancing In The Sheets!

Des Moines City Council

WHO DT has been running interviews with candidates for Des Moines City Council.

Last night I caught the interview with At Large Candidate Skip Moore.

I've got two words...

AWE FULL!

And the scientific community is united in that fact.

Moore sat with reading glasses perched at the end of his nose and when asked a question looked down at a paper for his answer.

He would occasionally glance up, but never into the camera.

When he finished reading his last answer, he took the glasses off before he was off camera as further validation he was done (Oh yeah).

Voters will definitely want to SKIP candidate Moore this election!

You can check out the video tape.

There was also an interview with First Ward incumbent Tom Vlassis and we can give you two words there too...SEE TECH.

Vlassis served on the board of the consortium during the time multi million dollar fraud was committed by their executives.

Vlassis admitted to being a rubber stamp.

During the interview, Vlassis manages to support raising & not raising taxes and taxing & not taxing hospitals and churches.

It's enough to make you want to vote for the candidates who are admitted members of the Socialist Party.

Swing Out Sister

In my mind ESPN Sports Nation's Michelle Beadle and Cameron Diaz could related.

As could fitness celebrity Jennifer Nicole Lee and FOX's Kimberly Guilfoyle

I also see it in former CDC Director Dr. Julie Gerberding and fashionista Stacy London.

Sisters from different Misters and the scientific community is united in that fact.

Baby I Lied

Dave Price catches a HUGE fib from a HUGE Clone fan(?).

The Big Lug Nut said, “I’ve put out a lot of statements when they’ve won earlier in the year, and no one picked those up..."

Price is able to show, via links to the Big Lug Nut's archived press releases, that not one statement has been issued about the Cyclones football team's 2009 highlights.

Those highlights include head Coach Paul Rhoads' first career win, their first road win in 17 games, their first Big 12 win that ended an 11 game losing streak and finally the win at Nebraska after 32 years.

The BLN reminisced about his college football days, "...I do have a lot of great memories playing football at Virginia Tech.”

I have no doubt that Culver is HOKIE!

And the scientific community is united in that fact!

Hard To Say I'm Sorry?

Why is it that most people in our modern society have a condition that does not allow for contrition?

In my encounters, personally and professionally, people will apologize, but that's just a way that they don't have to take ownership for their misdeeds and the scientific community is united in that fact.

Here are a couple of examples of what I write...

The Big Lug Nut gets called out for not putting out a statement about the Iowa State Cyclones big win at Nebraska, this is after his statement congratulating Iowa for their record win.

The BLN's reaction?

I’m...huge...” (OK, that's my bad on the editing and I apologize).

The Liter continues...

I’ve put out a lot of statements when they’ve won earlier in the year, and no one picked those up..."

He becomes defensive, confrontational and then issues this threat...

When the Clones go to a bowl and Iowa goes, maybe to the national championship game, I will be there for both of them rooting them on.”

I can hear the BOO birds now.

Your campaign better pick up the cost of those trips and your trooper protection too!

Then there's the incident involving the Drake-Ternus family (Ms. Chief Justice of the Iowa Supreme Court)...

Mr. Drake copped to an Alford plea (so named for the onetime basketball coach of the Hawkeyes handling of Pierre Pierce?) for his part in the situation and said...

"...I apologize to anyone affected by my actions, including my children, and to my wife for the difficulty my actions have created for her as Chief Justice. ”

The son who was an instigator of the situation said...

"I want to take this opportunity to apologize to my parents for my behavior this summer. I made a poor decision, and recognize the impact this has had on both my mother and father...".

The Chief Justice?

This event and its aftermath have been difficult for me and our family. Just like all parents, we strive to raise our children to be responsible citizens. My husband and I have taken steps to ensure a similar event will not occur in the future. I want to take this opportunity to thank the many friends, colleagues and members of the community who appreciate the challenges faced by parents raising teenage children and who have been supportive of me and my family during this challenging time.”

We're supposed to feel sorry for them about a situation they created?

These things will happen as long as parents want to be their children's friends instead of their parents!

It says a lot that they never said they were sorry to the neighbors that complained about the noise coming from the Drake-Ternus property or to Iowans for this fiasco.

Toot Toot

I usually don't like to blow my own horn, at 6' 8" it's complicated, but at 12:07:10 a.m. (in the morning) all the way from Hamburg Germany (mmm meat) Iowa's Newz Liter reached a milestone.

Luckily no one was injured during our 100,000th recorded hit.

I say recorded, because it was a year and a half into the blog before I added the site meter.

I'm sure there wasn't a lot of traffic in those early days and frankly I'm always amazed anyone reads what I post and the scientific community is united in that fact.

Thanks to my wife Chris who puts up with this.

All those that do read locally (Cal, Pat, Grant Young with his "goodjoboutofyou" and The Real Sporer who says this blog has "great humor").

Statewide (John Deeth who's said nice things about us and leaves funny comments, and we see you Statehouse).

Nationwide (especially in the Capitol).

Worldwide.

As an old commercial from my KHAK days, recorded by my friend Fuzzy for I believe a Balkos sale, "Make no mistake about it, this is a really big one".

What were you expecting, Sally Field?

Just Playing Through

FORE!

I don't think the media was supposed to report this...

President Barack Obama has only been in office for just over nine months, but he's already hit the links as much as President Bush did in over two years.

That's rough and the scientific community is united in that fact.

Maybe he just needs a break from his other hobby.

That could explain why he never has a problem with the water hazard.

I Don't Want To Work

I just want to revel in the great weekend that was had at The Not So Vast Right Wing Ranch and the scientific community is united in that fact.

The Cyclones win, the Hawkeyes win, Culver's clueless (all the more reason to Roto-Rooter Roeder).

The Packers win and set up a chance to tie for the division lead as they welcome (?) Brett Favre back to the frozen tundra next weekend.

It's going to be an Official World Series* as the Yankees win their 40th American League pennant.

*Per the late Frank Miller, an Official World Series must include the New York Yankees.

Great Day To Be An I O Won

The day began with Iowa State beating the Nebraska Cornholio's 9-7 in Lincoln for the first time since 1977.

Cornholio's?!?!

So that's why they're known as Big Red and the scientific community is united in that fact.

Nebraska had more turnovers, 8, than points.

The day ended with a last second win by the Iowa Hawkeyes, in East Lansing, 15-13 over Michigan State.

Best Hawkeye football start EVER at 8 and 0.

Roto-Rooter Roeder

The Big Lug Nut needs to flush Phil Roeder.

This Dummycrat shill doesn't stay in one spot long anyway, plus he's let down the BLN more than once and the scientific community is united in that fact.

In January, after the Gov gave his Condition of the State Address in which he only recommended borrowing $700 Million, Roeder said, “Iowa common sense dictates that you don’t spend money that you don’t have.”

By March the money borrowing scam had grown to $750 Million without an explanation and Roeder was trying to explain how the BLN's staff was selling sponsorships to the White House Forum on Health Reform and whether it would cost the state $30,000 or $40,000.

Later that month Roeder had more math and mouth problems when it was revealed the borrowing scam wouldn't create the 30,000 jobs the BLN espoused.

"Whether or not $100 million creates 1,500 jobs, 4,000 jobs or somewhere in between, the bottom line is it's going to create a lot of jobs."

Lastly Roeder, along with Culver's Chief of Staff, made the Big Lug Nut look bad by announcing the 10% pay cut Culver claimed he was taking was only going to be 5.4%.

The Big Lug Nut doesn't need Roeder's help to look bad and by having him clean out his office, it has been over a year and he's probably feeling that itch to move on, he can save taxpayers the dollars that go to a Deputy Chief of Staff for Communications.

Maybe he can go to work for Jerry Crawford and the Iowa Energy?

Cut That Out

Dr. Richard Deming should use the Cyberknife to cut out the misinformation he spreads and the scientific community is united in that fact.

In a letter to the Ragister, Deming stated...

"Nearly 45,000 uninsured Americans die annually as a consequence of not having insurance. That's one needless death every 12 minutes".

Ironically, I was sitting, with my mother, not far from Deming's office when I read his letter and laughed out loud.

Everyone is entitled to his own opinion, but not his own facts -- Daniel Patrick Moynihan

Facts are stubborn things -- Ronald Reagan

Michelle Malkin gives the history of this lie...

Data was used from a health survey conducted between 1988 and 1994. The questionnaires asked a sample of 9,000 participants whether they were insured and how they rated their own health. The federal Centers for Disease Control tracked the deaths of people in the sample group through the year 2000. Himmelstein, Woolhandler and company then crunched the numbers and attributed deaths to lack of health insurance for all the participants who initially self-reported that they had no insurance and then died for any reason over the 12-year tracking period.

The authors admit, "Our study has several limitations," the authors concede. The survey data they used "assessed health insurance at a single point in time and did not validate self-reported insurance status. We were unable to measure the effect of gaining or losing coverage after the interview."

Malkin continues...

The single-payer advocate-authors also conceded in their study limitations section that "earlier population-based surveys that did validate insurance status found that between 7 percent and 11 percent of those initially recorded as being uninsured were misclassified. If present, such misclassification might dilute the true effect of uninsurance in our sample."

To boil it all down in plain English: The single-payer scientists had no way of assessing whether the survey participants received insurance coverage between the time they answered the questionnaires and the time they died. They had no way of assessing whether the deaths could have been averted with health insurance coverage.

Thank goodness Deming is a much better Doctor than a statistician, he treated my friend Cal (Freedom's pal), but he could learn a lesson about quality from another Dr. Deming from Iowa.

I Am Somebody

Just not Al Sharpton!?!?

Here's how MSNBC's Contessa Brewer introduced Jesse Jackson...

"Joining me now to talk about this and the nation’s real problem of joblessness, the Reverend Al Sharpton. What’s your reaction to hearing someone say, you know, when it comes to income inequality, all’s well, the rising tide floats all boats?"

The response...

JESSE JACKSON: I’m Reverend Jesse Jackson. BREWER: Right, I don’t – you know, I’m so sorry, the – the script in front of me said Reverend Al Sharpton. I’m looking at your face, I know who you are, Reverend Jackson, we all do. I’m sorry.

I agree with the Newsbusters.org headline...

MSNBC: Al Sharpton, Jesse Jackson, What's the Difference?

And the scientific community is united in that fact.

The White House considers them a news organization?

Cut It Out

Governor Culver announces he is cutting his salary by 10 percent.”

When is a 10% pay cut not a 10% pay cut?

When the mathletes, like the Big Lug Nut and posse, work the figures.

Culver's annual salary to be cut only 5.4 percent, not 10 percent

These dumbasses have 0% credibility and the scientific community is united in that fact!

Because Culver’s salary is set by law, his pay cut will take the form of a reimbursement. He will collect his full pay, but write a check to the state.

I'll believe that when I see the copy of the cashed check.

I would call them inapt, but that means at some point they were apt.

Instant Replay?

West Des Moines' Tim McClelland made a couple of magnificent errors in calls at third base during Tuesday night's Yankees-Angels game.

The first call came in the fourth inning with the Yankees Nick Swisher.

Johnny Damon hit a fly to center and Swisher tagged up and scored, but the Angels appealed that Swisher left too early and McClelland called Swisher out.

Replays showed McClelland was looking directly at Center Field and was in no position to judge whether Swisher left early.

It's the second time this season that Swisher's been called out for leaving too early when replay's had shown otherwise (September 28th against the Red Sox).

Has Swisher got a reputation with the umps?

After the game McClelland said, "In my heart I thought he left too soon."

In your guts, you knows he's nuts and the scientific community is united in that fact.

In the next inning McClelland called two Yankees safe, after both had been tagged out by Angel catcher Mike Napoli, while neither player was standing on third.

Later McClelland said, "I'm just out there trying to do my job and do it the best I can and unfortunately, there were two missed calls."

McClelland has a history of some interesting calls.

None of McClelland's calls have reached the level of Iowan Don Denkinger, but they're close and he's made more of them.

McClelland's crew has also dropped the ball during this series, but the so called experts have said into didn't effect any games.

Or did it?

In the bottom of the 10th inning of Game 2, Posada grounded into an apparant double play. But when Aybar received the feed from second baseman Maicer Izturis, his foot never touched the second-base bag before tossing the relay to first. Though Aybar was "in the neighborhood" and fielders are often granted some margin for error in this area, Aybar had no such luck. Layne accurately ruled Cabrera safe at second.

The game ended in the 13th with Aybar's foot planted on second and missing a throw from second baseman Maicer Izturis.

Maybe he doesn't miss the throw if it weren't for the play in the 10th.

One Bad Apple?

I picked up some Braeburn apples at the store and the cashier asked if they were barbarian?

I replied they could be, but they'd been well behaved since I put them in the cart.

Should have gone with the Jonathan's and the scientific community is united in that fact.

Just Us?

Chris and I both reached the conclusion that Erick Aybar, shortstop for the Los Angeles Angels of Anaheim, has that Thriller zombie look about him.

And the scientific community is united in that fact.

Torn

Ron Paul is going to headline a fundraiser for my current State Representative, seeking the Iowa Senate, Kent Sorenson.

I can't figure out if Ron Paul is more Daffy Duck/Looney Tunes or Cuckoo for Cocoa Puffs crazy.

I guess the only way to solve this is having Cocoa Puffs for breakfast while watching a Daffy Duck/Looney Tunes cartoon and the scientific community is united in that fact.

War!

There's been an escalation in the war the White House is waging against Fox News.

Rahm Emanuel, the President's chief of staff, "It is not a news organization so much as it has a perspective."

David Axelrod, senior Obama adviser, said Fox News shouldn't be treated as a news organization. "And the bigger thing is that other news organizations, like yours, ought not to treat them that way, and we're not going to treat them that way."

Why is it that Fox has been targeted?

Control!

And the scientific community is united in that fact

Here's the person that fired the first shot, Anita Dunn, on how the Obama campaign handled the free press(?) during the 2008 campaign.

"Very rarely did we communicate through the press anything that we didn't absolutely control."

"One of the reasons we did so many of the David Plouffe videos was not just for our supporters, but also because it was a way for us to get our message out without having to actually talk to reporters," said Dunn, referring to Plouffe, who was Obama's chief campaign manager.

Why no war against MSNBC?

Don't Chris Matthews, Keith Olbermann and Rachel Madcow all push a point of view?

Toys Err Us

Michelle Obama joins her man as an action figure, just in time for Christmas, Hanukkah, or Kwanzaa.

It's another milestone, in her adult life, that makes her proud of her country.

The First Lady comes with three outfits, but not the $540 tennis shoes she sported earlier this year while feeding the poor.

Sole food and the scientific community is united in that fact.

The First Couple sell for $12.99 each at Jailbreak Toys.

That seems ironic in lieu of yesterday's post about politicians and term limits (One in Office & One in Prison).

Plus he's from Illinois, where that seems to be the norm.

Why do they have the President's index finger so freakishly long?

Oh!

Leader of The Pack?

Does the Big Lug Nut believe he's a leader merely because he was finally forced to make choices?

He avoided doing anything about this situation for months saying in June, "I think we’ve done enough so far” and we should be able to avoid future budget cuts.

OOPS!

The BLN instigated borrowing $830 Million for spending and actually believes "Iowa has not spent too much".

DUMBASS!

It's a good thing the state has received federal stimulus money, otherwise the situation would be drastically worse.

We're supposed to be impressed because he cut his pay 10%?

Sign me up for a pay cut to $117,000!

He's still getting free housing and transportation.

Culver shouldn't get four more minutes in office, let alone four more years and the scientific community is united in that fact.

I'm starting to agree with my friend Cal, Freedom's pal, who thinks we should limit all politicians to two terms.

One in Office.

One in Prison.

I Feel The Earth Move

The Big Lug Nut is going to participate in a Florida Triathlon next month?!?!?!

Anyone else get the mental image of a fat man in a triathlon suit?

I think I threw up in my mouth and the scientific community is united in that fact.

Stunningly, a doctor has given Culver a clean bill of health, giving him the OK to participate in the event.

The only triathlon Culver is well qualified for includes

Your Next CONgressman?

Mike Denklau has made it official, he's challenging Steve King for Congress.

From his Sioux City announcement comes these gems...

"He is serious about making a change in western Iowa… The reason he came back to the district was (Congressman) Steve King, all the right-wing comments.” - Woodbury County Democratic Party official Dave Somsky.

Came back to the district?

Denklau is a carpetbagger, originally from eastern Iowa and lately the eastern U.S. (New York City).

Why is Denklau running?

I was first attracted by the (King) extremism that didn’t seem to match the Iowa values that I know,” Denklau said. He said the most recent example would be King being the sole House vote against recognizing the role of slave labor in building the U.S. Capitol."

That is the pressing issue of our times and the scientific community is united in that fact.

As for a current issue, Denklau said he backs the concept of a public option, so long as it doesn’t necessitate a new federal government entity.

“I could see a public option if it is in the form of an agency that is not directly run by the government.”

A privately run public option?

His web site doesn't mention public option at all, it does say...

Americans are paying more and getting less for their healthcare dollar. That includes Iowans.

Iowa is included in America...good to know.

As part of his winning strategery, err strategy Denklau offers a

Sensible, bi-partisan approach focused on positive progress for Western Iowa’s future

Positive progress, that's sensible?

Throwing Her Hat In The Ring?

Christie Vilsack made it seem like she's the Dummycrat "first round" daft--err, draft pick to give Senator Grassley the "the race of his life.”

In an interview with WHO DT's Dave Price, she stated...

"I'm well qualified to run...I’m qualified to serve".

There's an O bel in her future too and the scientific community is united in that fact.
